Sometimes back when the Delhi rape matter of Nirbhaya @ Jyoti Pandey @ Damini's was on high, everybody was reacting including crooked politicians, I thought to write about it but then postpone the idea. Again, yesterday I heard name of Bitty Mohanty and his arrest. I had almost forgotten him. I am a strong follower of news relates social, economical and political issues related to national and interest of everybody. I am a very curious person and always search to find out what end has happened to certain incident.
I was very interested in Bitty Singh's case and it was making me very angry too (I am still angry). It was highly pathetic that despite of involvement of his father in his parole and to abscond him, his father enjoyed job as an IPS officer and retired.
The brief details about it is follows:
He was charged with raping of a German national on 21 March 2006. The German lady and Bitti Mohanty were on a holiday in Rajastan and took a hotel room at Alwar on 20 March 2006. He was convicted on 12 April 2006 by a fast-track court and police from Orissa and Rajasthan have failed to locate him thence.
For me, definition of rape is to establish sexual relationship with someone without his/her consent. In this case, nowhere it is visible that the girl provoked him to do so or the girl had intention to blackmail and take money from him or the typical "rape case" where a girl or woman makes sexual relationship with full consent not once at various time and at later file a complaint as a rape because the man did no marry her (I do not consider it is a rape). Rape can happen even of a prostitute if it has happened against her own will and consent.
After the rape, the fast track court in Rajasthan convicted Bitty Mohanty within 13 days. Judiciary acted well however the bureaucratic and political nexus allowed him to jump the parole.
He was granted parole on 20 November 2006 to meet his ailing mother (the conspiracy planned possibly by his family members to help him absconding). The parole was granted within 8 months of his conviction. It is very surprising how he got it? If we go through the records there are thousands people who are poor and convicted in much lesser serious offences and have very serious reason but never got parole.
The fact of this case is that His father, Bidya Bhushan Mohanty (B.B. Mohanty) was an Indian Police Service officer, stood as surety for his son's 15 days' parole. He was an IPS officer selected through stringent selection process through civil services exam. Such officers are known as elite, intellectual and hold key position in bureaucracy. It is openly known fact that he stood for his son and helped him to hide. He had given surety for his son's parole. His son never returned and finally this useless father suspended and arrested on the charges of helping, hiding and harbouring his son. He even told that he does not know anything about his son and perhaps he is not alive.
He was later reinstated into service in 2009 and retired in 2012. This shows inefficiency of government and political bureaucratic nexus. The crime was not simple or mistake. It was wilfully done. His son did it because he was sure that nothing will happen to him as his father is there to help him. In fact he helped to suppress the matter and helped his son to break the law and flee. B.S. Mohanty was an senior IPS officer and was holding a key position in state police department. His role was to maintain law and order in the society and to hold head high of the law. By breaking law and misusing his position and by helping his son to break the law, he himself became ineligible for the position then how state government gave him his job back it is under question and we must ask this. Similar thing had happened in Rathore's case who molested a teenage girl, forced her to commit suicide and created lot of trouble for her family. They suffered for years without justice and finally they gave up.
Another fact of the Bitti Mohanty case is that A.S. Gill (the Director General of Police of Rajasthan) and B.B. Mohanty were batch mates and it was alleged that the investigation was slowed down due to intervention of high-ranking officials. The investigating parole officer was transferred abruptly on 29 May 2007 and this hampered a speedy investigation. A.S. Gill was aware about the plan and helped B.S. Mohanty and his son. He is also a criminal but enjoyed his position. When a clerk does a mistake the head of the department is held responsible; when an employee commits anything wrong the directors are held responsible then how Gill is not responsible?
When Bitti Mohanty was arrested, he was working in State Bank of Travanacore using a fake identity. This also tells the lapse in background check of employees in government organisation. This also tells that even a terrorist can get easy entry into government job and important financial institution. Although his MBA was not fake, he earned it what about SSC and HSC? All those exams he appeared and cleared under the name Bitti Mohanty only. Why his education qualifications background and address verification not done? Selection for banking happens through selection board (IBPS) and still he get through ! All these are questionable. There are news reports that at least 3 close family members were in touch with Bitti Mohanty during his hiding period. Even the principal of one of the colleges told that one person used to come to meet Bitti regularly. Bitti Mohanty caused after social media networking and TV channels constantly shown culprits who were involved in high profile rape cases after the Nirbhaya incident. Somebody possibly a customer identified Bitti and sent a letter about it to bank and then he got arrested. Could not police and media constantly flash photos of him as well as other accused regularly on social networking sites as well as TV till the culprit get arrested? It could have been done but nobody bothered.
Now coming to Sheila Dixit, she is such a hypocrite that first she helps Manu Sharma a murderer of Jessica Lal to get parole and she is not able to control crime there and when media and everybody show anger, she starts to behave as a common man and say that Delhi is not safe for women. Even her daughter feels insecure. Shame on her. She is CM of the state and can give such irresponsible statement. If she says such thing, she must resign. A girl from sales team of a hotel on Delhi came to meet me for a business deal and when I asked her reason for so much crime in Delhi, she told me that since every criminal has some kind of political nexus so police also do not take action against them. Therefore they dare to do so. Here, the reason for crime including rape is very clear. Can Shiela Dixit and other politicians like her end political,bureaucratic and criminal nexus? I think no. It benefits them only. Even judiciary is questionable. When police used force on lawyers demanding and protesting for subsidised land, Rajasthan high court took no time to remove police commissioner. Where was this judiciary when despite of criminal IPS officers like BS Mohanty and A S Gill were enjoying all the benefits and positions? When Shiela Dixit was helping a murder convicted to get parole to enjoy party?
The rape accused in Nitbhaya's case got arreated because they were not rich and did not have any political connection. Nothing has changed in Delhi even after the Nirbhaya case. Rapes are happening now and then, crime is still happening. By the time I am finishing this blog post, there is news that Ram Singh, the prime accused in Nirbhaya rape case has committed suicide in the jail. He did so because he knew that he does not have a rich daddy and a political connection who will buy judiciary and all to save him.
P.s.: Yesterday I read Rahul Bose's tweets that all criminal including rapist should be given one chance to reform and even if we do not see remorse on their face, we should not give chance. True, somewhat I agree too
I also saw strong negative reaction from people too. When I saw photos and videos of Bitty Mohanty, he was smiling (recent one after his arrest in kerala) it was seeming like he is smiling on his power, his achievement and our inefficiency for delivering justice. Now, to reply to Rahul Bose, Bitti Mohanty did not see remorse and made mockery of law. So he should be given capital punishment.
Non-governance and dereliction of duty is the rule-of-the-day in the Indian Government. We can think of justice in the Delhi case from the rogues in the Parliament, only if the official were punished who had used force on demonstrators against the rape. Judiciary is equally at fault as related by lawyers, so it should also fall under Jan Lokpal of Anna Hazare !

To bring changes first we need to change ourselves, our attitude, our mentality and more, we have to take responsibility that this is our country and we need to be a catalyst to bring changes. If every citizen spend 1 hour for the clean up of the system and fight for the wrong, in 5 years we can get the India , the golden India of bygone era
DeleteI wrote the above post on March 10th 2013 more than a month back. When I wrote I was sure that such incident will repeat in Delhi and this time to the political people including Shila Dixit will try to prove her innocence. It happened. People's first movement did not awake them. The home Minister B....d Sushil Kumar Shinde, a pandu from Solapur who is equally corrupt make statement that "Rape happens all over India" shows their attitude well. I think he has not got the pain of being raped- of him and his family member.
ReplyDeleteOn April 15, a child of just 5 years brutally assaulted and raped by two person and they raped till she fell unconscious. This is the mentality of such insane people. What enjoy one can get from a girl who is just 5 years who does not know anything?
I think this is the time we need to awake and fight till system completely changes. Now we must demand direct power in hand of the people instead of these B...d fake people's representatives.
We all are frustrated seeing again and again same wrong doing by different people from all the classes. Whether he is educated or uneducated no matter people are playing paying bribes coming without any fear of law!!!! Our politicians are corrupt our police force being misused by them... The situation getting more and more wors.. A Rape culture is happening everywhere from South to west to east of India and North is the king city of rape!!! Shameful act
ReplyDeleteB B Mohanty was rewarded at each stage of the case against hims for forging documents to get his rapist son on parole and then to abscond. As soon as the case was charge-sheeted, he was released from suspension in March, 2009 just before counting was to start. When evidence has been found against him for creating passport & fake identity of his son to appoint him in SBI, he has been suddenly cleared in departmental proceeding and his full pension has been sanctioned by DGP Sri Prakash Mishra without bothering for trial of the two cases against him. For all out help to crime against women and greatest forgery in criminal history, Sri Prakash Mishra has been posted as Spl Director , CBI.
ReplyDeleteThanks a lot Arun for this update. We did not forget to protest Delhi rape but why are we silent on this? Bitty Mohanty's father was mastermind for hiding him and creating false identity. Should not he have been jailed for destroying evidence, perjury and as a co-accused in rape.
