How to get FIR registered in police station without too much hassle when you lose your valuables in train



Getting an FIR registered in any police station is a toughest job. First of all, whatever may be the nature of crime, police does not want to get register an FIR as it shows that in their area, crime rate has increased. At least 90% of crime in India gets unregistered due to this only.

I have several such experiences where police does not file an FIR. The moment police starts to register FIR (First Information Report), then we will come to know exact number of crime happening in any area and that will also make them really work for the work they have been hired. When they refused to register an FIR, they are violating the law. Section 154 of the CrPC (Criminal Procedure Code) makes it mandatory for an officer on duty to register an FIR.

The cases of refusal to lodge FIR in the police station, specially in Railway
Everyday, I believe more than 3000 people lose their mobile, tab and valuables in local trains and bus in Mumbai. The number can go more too. Whenever you go to railway police stations, police stations etc. They refused to lodge FIR. They handover you the missing complaint report. The missing reports do not make them accountable to do investigation and crime. For insurance settlement, re-issuance, these missing report does not work and you have to have an FIR copy. Always insist for FIR copy. For important documents like passport, driving license, smart books/ smart card of vehicle registration, RC book, insurance claims FIR is must. You must insist for registration of FIR and copy of the same. The excuse that they cannot give you FIR without investigation is false. 

a) Matrimonial disputes/ family disputes
b) Commercial offences
c) Medical negligence cases       
d) Corruption cases       
e)  Cases  where  there  is  abnormal  delay/laches  in  initiating a criminal prosecution,  for  example,  over  3  months  delay  in reporting  the  matter  without  satisfactorily  explaining  the reasons for the delay.        The aforesaid are only illustrations  and  not  exhaustive  of  all conditions which may warrant preliminary inquiry.


 Now, I hope it is clear to you also about FIR process. 

Now coming back to another main point when can and cannot an FIR be registered. Any matter are of two types i.e. cognizable offence and non cognizable offence. Cognizable matters are related to crimes and attracts imprisonment whereas non cognizable are small incident such as fighting, quarrel, dispute etc. 

For every cognizable offence such as beating, harassing, dowry, loot, theft, arsoning, harming, murder, stealing and so on, FIR registration is compulsory.

As per the CrPC (Criminal Procedure court) incidents are divided into two categories that is cognizable and non cognizable. For cognizable case police can register an FIR (First Information Report) and investigated further. This is govern by under section 154 CrPC.

Also incase of non cognizable incidences/offences police registers the information but advices the complainant to approach court/ other legal mechanism for remedy. FIR of cognizable offences is governed under section 154 CrPC whereas non cognizable reports are governed under section 155 of the CrPC. Procdure and important aspects of the First Information Report (FIR) of cognizable offences are mentioned below:

The complainant suppose to get the signed copy of the FIR at the police station at free of charge.

FIR is register as soon as without any delay after the incident.

Place & time of incident and about any other important avidance should be mentioned during the FIR registration process

The reason should be clearly mentioned if the FIR registration is delayed.

Any information other then written or oral in the Police Station is not considered as FIR, its just information.  Police does not carry any type of investigation on non cognizable offence report.

After the FIR registration police investigates the case collect evidences gets the statement of the witness and prepair Final report known as chargesheet and submit it before the Court for further process.

Incase of insufficient or no evidence in the complaint police submits a Final Report which is known as FR.
Note:
If the complaint is found false and fake police submits the closer report as per the process defined under section 182, 211 IPC.


 Now, what if a police do not register an FIR? What do I need to do or what should I do? Forget about FIR, even if police do not act on my complaint then what should I do?

I lost my wallet (somebody stole it in a local train in Mumbai when I was traveling back to home with my family) and when I tried to register an FIR (as the wallet had my bike RC smart card and driving license too), the police constable even did not take my complaint. What I did?
I immediately wrote an email to Mumbai Railway Commissioner at cp.railways.mumbai@mahapolice.gov.in  and within a week, I got call from Dombivli Railway Police Station. They took my complaint and handed over an FIR copy to me. 

My friend has told me that I will never get an FIR, they won't register it. Sometime they talk about jursidiction, sometime they need mobile IMEI and serial no, sometime they need documents number and all such excuses. Believe me! these details and documents are not required for FIR. You can lodge FIR in any police station and the police station can transfer the same to the respective police station?

What you should do?
Never settle for a missing complaint. It is their responsibility to register FIR and investigate the crime. First, insist for an FIR, if they don't, give them written complaint and take stamp on such letter. After that send that letter's scanned copy through email to the respective police commissioner's office / Police Superintendent (SP). If email id i not available and the commissioner's office is nearby, please submit the letter of the complaint mentioning the incident, name of the officer, what happened with date and time and specifically mention to convert this complaint into an FIR. If SP/ Commissioner's office is far away, please send the same through a registered post with AD. This will definitely going to help.
