Power franchisee told to reply to RTI queries- now Torrent Power also comes under purview of RTI

This landmark judgment is also helpful to unearth nexus between politician, MSEDCL and Torrent Power who has taken franchisee of power distribution of Bhiwandi.

As per the sources, the Torrent Power paid 50 lakhs as a "fee" to present Shiv Sena MLA of Bhiwandi Rupesh Mhatre to make the power loom agitation a failure. Equally, it pays lakhs of Rupees every month to DCP, ACP, Sr. PI of various police station in Bhiwandi and also to mayor and corporators.

The same is charged through heavy bills to consumers. I am planning to file RTI application on this to MERC, MSEDCL and to Torrent Power.

MUMBAI: In a landmark order, Aurangabad information commissioner DB Deshpande on Monday ruled that Global Towers, a franchisee of the Maharashtra State Electricity Distribution Company (MSEDCL) for Aurangabad city, came within the purview of the Right to Information (RTI) Act and was bound to provide information to power consumers.

A section of MSEDCL consumers led by Hemant Kapadia had approached the information commissioner saying their RTI applications were rejected by Global Towers on the grounds that it was a private company and so was not bound by the provisions of the RTI Act.

MSEDCL had appointed Global Towers as its franchisee for distribution of power and allied services for Aurangabad city on May 1, 2011.

MSEDCL representatives submitted before the commission that all applications received from consumers under the RTI Act had been forwarded to Global Towers, but it did not respond and so no information could be given to Kapadia.

All along, Global Towers had taken the view that it would provide information to MSEDCL and that there was nothing wrong in denying information to consumers. In some cases, the firm did provide information, but it was submitted to MSEDCL and not the consumers.

Global Towers lawyer P R Patil submitted before the commission that his firm did not attract the provisions of the RTI Act as there was absolutely no involvement of the government in it.

In his 42-page order, Deshpande said that Global Towers had received more than substantial assistance from MSEDCL.

"Owing to the assistance of MSEDCL, the firm is able to perform. The nature of task performed by the firm is a type of service. Under such circumstances, I have come to the conclusion that the firm comes under the purview of the RTI Act and is a public authority,'' Deshpande observed.

Deshpande directed the firm to appoint a public information officer and an appellate authority within 100 days and ensure that information is available to the common man on its website.
