Bad governance keep a rich city in poorest condition

Friends,

This is something I started as I could not tolerated and this have taken my all patience.
It is surprising to me that despite of having 20-25 press reporter from all major channels how they did not report this thing for years. And as a known fact, all of them were being paid bribe from Municipal commissioner. I have started an online petition by taking responsibility. I request you to share this with maximum  people, publicise it in news and also sign this petition.

Subject :Petition and second reminder against pathetic condition of the city in terms of sanitation, bad road conditions, illegal constructions and haphazard management of the city and complaint against Municipal Commissioner’s office for inefficiency.

Dear Mr. Hange,

Kindly refer our letter to you dated  08th May 2012 but your office refused to accept it ) kindly find attached annexure), We tried to send you the same through fax but various attempt failed. We sent the same to your e-mail id too, which got bounced and we resent it through speed post and finally it delivered on 06.07.2012 (see annexure 2).
In this complaint, we highlighted about the pathetic condition of the city. We asked you to take action against the problem highlighted, but for our surprise no corrective action was taken. Instead we are seeing the condition of city is becoming worse day by day. It shows your willful failure or not to do anything.

It is highly surprising that your residence is at Mansarovar, Bhiwandi which passes through Kalyan Naka-Dhamankar Naka - College Road,-VaraladeviTalao- Mansarovar and all the way garbage as well as bad roads, illegal construction development are clearly visible still we did not see any action from your end. Even if you choose another route through Aasbibi-Kamatghar or through Mandai-Dhamankar Naka-Varaldevi Talao,  from office to home everywhere the situation is same (the bad roads, garbage, people urinating in open, stinking road which has converted into open toilets,. Still there is no action? Even if you do not visit different wards/ part of the city, on the way, real face of city should be clearly visible to you. Anywhere we the residents of Bhiwandi go, situation is same. Garbage is everywhere; roads are damaged at such extent that it is not at all motorable and full of dust. If a person is allergic to dust, it impacts heavily on such person.  This is not limited to this, roads have such big holes that if a new person comes or by mistakenly does not take care, it is sure that he is going to stuck, a major accident can happen or things can be worse than this.
Such bumpy road may lead to fatal accidents and dangerous for patients, old ages and pregnant women.
It seems that you have deliberately ignored all these facts because either you have vested interest on it or else you are not present in the city for the duty assigned to you.
Till last week, we, the group of citizen have collected various footages and sending the same in CD with this letter. Some of the worst conditions we are mentioning here:
1.      The condition of Dhamankar Naka fly over bridge is very bad. It seems it has not been repaired for years.

2.      The area next to Dhamankar Naka Bhaji market and opposite The North restaurant is worst. The road going towards Kalyan Naka and BNCMC office is already narrow due to bridge and it is always full of garbage which stinks badly. People also urinate openly there, road is in very bad condition. People cannot walk as there is no space and vehicle cannot pass as you and the people assigned the task to make the city livable are not doing their work.

3.      The area opposite of Pathare Compound, Dhamankar Naka, College Road, Bhiwandi also has similar condition, garbage is thrown openly, no cleanliness. School is there, people urinating openly. What kind of scene and education we are giving to our children? Would you like that your children should go for college and have such “pleasant” scene?


4.      The roads in entire Padmanagar, right from the area of Bhaji market towards Varala Devi Talao and the area from Bhaji Market to GeetaMandir and towards Ganesh Talkies are in very bad condition. Similarly the road of Padma Nagar, opp. Pathare compound i.e. from Shankar Kamtam building to towards DattaMandir is also in very pathetic condition. It seems that we have come into a poor village where roads are bad and non motorable. Further, none of the city’s internal roads are managed, repaired and taken proper care for the reason best known to you.

5.      Area near Patel compound from where the Dhamankar Naka bridge starts has a garbage bin. Throughout the day and night, it is clearly visible that garbage including residues of Banana and in worst scene legs, skin, bone and other leftover of the killed chicken are thrown. Somebody may feel to vomit after having such scene.

6.      The similar condition of the garbage box of opposite Ajmer Nagar, Narpoli is visible. Here to, half of the road is filled with the garbage and children from slum area are openly answering their nature’s calls (in other language, they have made the road an open latrine).


7.      To repeat again, the road in the entire city is in very bad condition. This is not a new thing, you can refer the earlier complaint sent to you (copy attached). Specially Narpoli near police station, the portion of the road has big potholes and it is definitely dangerous. In Anjur Phata, right from the area of TMT bus stop upto Octroi Naka and upto the traffic control room does not have a dambar or tar road. It is for almost a year and we can see lot of dust. If somebody has taken bath and pass through the road, the people need to take a bath again.

8.      There are not enough urinals and public toilets. Whatever are there, they are constructed years back. The worst and shameful is that women and other general public have to see people passing urine openly in the public. The worst area is next to Bhaji Market, Opp. Tree house play group and nursery (Below Dhamankar Naka bridge), college road, Kalyan Naka, near Rais high school, Opp. Payal Sandwich, Rabee Plaza, Payal talkies road, area of Payal talkies, Gopal Nagar where Rajiv Gandhi bridge ends and many other parts of the city and think how you will feel if your children have to see it and go through the stinking.


9.      The roads on Khadipar not at all constructed.

10.  The roads in Dhamankar Naka in and around Bhausaheb Dhamankar Statue where SRPF van stands and roads going towards Payal talkies i.e. Old Thana Road is also in very bad condition.


11.  The area of Ajanta Compound, The lane passing next of Dhamankar Naka Bridge is also in bad condition. Again it seems that it was never repaired.

12.  The roads from AnjurPhata to OswalWadi to Shankar dying to Dhamankar Naka is in very bad condition. The worst is area opposite of Shankar dying, the entire one lane has damaged for almost 2 years and not repaired. There, we can see always tanker standing .Garbage are thrown and burnt.

13.  The road of intersection of Devji Nagar, just opposite of KashinathPatil hospital is in very bad condition. At least 5 time it was visible that people dumped debris of the building to fill the bigger hole and avoid accident but was it a solution? Never.


14.  Area of Kalyan Road near Ghunghat Nagar, behind Mahindra Two wheeler showroom is also equally in bad condition. The road is not repaired and garbage is thrown there. It looks like you are forcing people to live in very unhygienic condition. The road is also in very bad condition there too. When we spoke to citizen over there, they informed that they complained about it still there is no response.

15.  The area opposite of Madhav Nagar, Durga Hotel, Dhamankar Naka also has become another dumping ground for garbage and road again is in pathetic condition. Walking on the road is very difficult.

16.  It is bizarre that Bhiwandi is the city in Mumbai Metropolitan region which does not have no parking designated and other area like no parking, no U turn, one way, silence and other zone. Vehicles are parked anywhere and by taking monthly fixed bribe by the concerned police authorities and your people have not taken any action against such thing. Few of the major problem and examples are from Dhamankar Naka down the bridge to BirjuPavBhaji to Sagar sweets and Shivam sweets towards college road, vehicles are parked as per the owner’s will. Other areas are Sarika Hotel (Payal talkies), Shiv Shankar juice centre (opp Payal talkies).  It seems people do not fear of municipal corporation and police department and it seems  police fear from them, worst, I have never seen a police constable regulating teenager speeding bike, regulating trafiic in Dhamankar Naka. The area down the bridge has enough space and strictly can be enforced as a parking area. Even the area opposite of Sagar sweets has similar situation. It seems that city has more bikes and vehicles than the people. Bhiwandi’s roads are smaller than a gully (lane) and even in that, the both side of the roads are full of vehicles and no space for people to walk. Forget about to maintain an ideal city with separate pedestrian road and cycling zone. The area mentioned (Dhamankar Naka) has hospitals, medical, biggest college of Bhiwandi (BNN College), PadmashriAnnasahebJadhav School and Junior College, Poddar English medium School and Satyanarayan Hindi high school. It is clearly visible that the area falls under silence zone. It is also unbelievable that you cannot hear or see these entire situation. Prima facie, you have turned it to deaf ears. Apart from this, the similar situation is at a pan shop just at the starting of Dhamankar Naka fly over bridge from Narpoli’s side. In the evening, many bikes are parked on the road covering half of the road. There is no absolute control over it.

17.  There is no different zone like one way, no U turn, no parking etc in Bhiwandi as mentioned above. We must thank to Ms. RashmiKarandikar (Ex ACP, Bhiwandi) who tried a lot to bring reform in the city, fought with you people to construct divider and started penalizing offenders. During our meeting with her about the problem, she mentioned that how officials from municipal corporation were warning her against creating dividers and asked not to do any such act.  It clearly shows how the municipal corporation is with the law breakers. She also mentioned that how a doctor from Deep nursing home tried to prevent her from constructing divider and threatened her. She asked help from NGOs and people including us to take action against offenders under motor vehicle Act and unfortunately we did not, finally we lost a sincere cop who tried to make the city civilized. We are not seeing any such proactive work from current ACP of traffic of Bhiwandi.It seems he is busy in something else, best known to him.


18.  As per the recent forget about the 20 micron plastic bags and more, the thinner plastics are openly given by Vegetable vendors, milk sellers and by local Kirana stores and in these 2 years, you never took action and did not make the city plastic free. We can see such efficiency in Thane Municipal Corporation, MCGM etc but not in a municipal corporation attached to these cities.

19.  For last one year you have not updated Municipal Corporation’s website. There is no mention of your e-mail id. There is a link “register a complaint” but it is not working. Purposely you have not given correct fax no and also you have not displayed your mobile no so people could directly approach you.
20.  There are many illegal constructions going on in and around the city. Last time we asked about legality of certain buildings but your department was so clever that despite of giving complete address, you people asked to provide Survey no., hissa no and other details to provide details. Who is making fool to whom? Is an ordinary citizen has information about all the survey no. and hissa no. of the city? It was an attempt to hide and protect such activities. Few of the observed illegal construction areVishu complex, Opp. SP photo Studio and poddar high school, college road, Dhamankar Naka, Bhiwandi. 2. On Thana Road, opp. HDFC Bank, above Indian bank, another floor is raised and the same was published in a local newspaper too but it is more than 6 months, the floor exists. How one can raise a floor on 20+ years old building, who granted the permission?. Similarly such types of activities are happening in Narpoli, opp.Devji Nagar and other areas. Who will be responsible if any unforeseen event happens. It is believed that 80% of Bhiwandi’s constructions are illegal and you people have never taken action in sum of heavy bribe. (otherwise why there is no reason to take action).

21.  Bhiwandi has a pond bigger than of TalaoPali in Thane but it is so badly managed, it adds worries. Your home is just opposite of the VaraladeviTalao but it seems you are busier in money making than making of the city. The Varaladevi Garden management is given to Ajay Palke and his brother, a person who does not have any expertise on this. How is it possible? The garden is also in such a bad condition, encroached, damaged (It is a huge area and can be developed as a very good recreational area), no doubt there is a huge scam in this and everybody is making money from the taxpayer’s hard earnings.


22.  ParshuramTawre stadium which is meant for encouraging sports is in such a bad shape that people from a descent family will never send their children and women to the area and many are still not aware about facilities available.

23.  One garden is given name in the name of deceased mother of a corporator and a hall on deceased wife of the corporator. Is the land belongs to these corporators and have they born expenditure of construction? If not what are the credentials of these people so give the hall in the name of these people? Please explain contribution of these people to the city and the society.


24.  Illegal hoardings are rampant in Bhiwandi whether it is Anjurphata, Mandai, Dhamankar Naka or Kalyan Naka, it ecists everywhere in the city. All these illegal hoardings are political only. It is worst to see that common man in Bhiwandi is paying money to the corporation and advertisement agency to advertise their product, services and message but the illegal hoardings from political outfits are always on above of these paid hoardings. If you cannot remove such illegal hoardings how can you charge people? Either you are scared from them or you do not want to take action purposely. Bhiwandi is not such a big city that it will not come to your notice.

25.  You are holding public meeting or hearing once in a month and making compulsory for people to attend personally. Why, is it a democracy? You should accept problem, grievance and communication from people in any media- through mail, sms, letter and fax. You are not a ruler, note that you and the entire servants of the corporations are public servants who are feed on our taxpayer’s money. Even a beggar pay taxes when he buy something in form of indirect taxes. You cannot go away from your duties and responsibilities. It seems you have sold your soul and ethics everything for money. You alone are not responsible for this, it is a big nexus.

26.  The drainage systems of the city are equally bad. During rain, many drainage system fails, gutters and nallahs are open, not cleaned. Padmanagar and Mandai particularly remains under water logging even in a slightest rain. This is not done.

27.  Many areas in Bhiwandi has been encroached and slums have increased particularly in area like Naigaon, Gaibi Nagar, Balaji Nagar, Vitthal Nagar, Bhandari Compound, Kamatghar to name few. In Kamatghar, 10 years back, we used to see lot of open space and now it has been occupied by jhopdas and slums. We are sure in recent 15 years, the municipal corporation has not given permission officially for these slums and you have not taken action to prevent for the reason best known to you- possibly to facilitate politicians to create vote bank and allow your officials to collect huge sum of bribe and haftas.
Few facts
1.      Bhiwandi is the richest city in Thane district but it is in the worst (poorest) condition. Bhiwandi receives lot of funding including from MMRDA plan, from state and central government, from octroi and various other taxes but it is managed worst and neglected. God and only YOU know where has all money gone. One of us is working in a very large MNC as head of all India operation and had been to one seminar, there a person asked him where do you stay. After listening “Bhiwandi” the response was “I had been there only once and I never prefer to go”. Due to such image you have given to the city that people have to think 10 times before applying for a job as Bhiwandi itself become criteria for rejection considering its bad reputation.

2.      Please refer the case of Ratlam Municipal Corporation V/s Vardhichand and ors 1980 AIR 1622, 1981 SCR (1) 97 where the hounourable Supreme Court ordered municipal corporation to remove the public nuisance, to construct drainage pipes. Here, the honourable court clearly directed that the municipal corporation cannot give excuse of having lack of fund. For Bhiwandi, at least question of fund does not arise as nothing has been done. Please note that the order of the Supreme Court becomes binding automatically and violation of this may attract action as contempt of the court. By not fulfilling your duty you are liable to hold responsible for contempt of the court.


3.      As per the article 21 of constitution of India, a person has right to live life with dignity and a state cannot violate the fundamental rights. It is duty of the state i.e. municipal corporation to provide such an environment so people can live life with dignity. Bad roads, bad traffic, garbage, improper drainage system definitely do not help one to live life with dignity. Being head of this municipal corporation, you are violating our fundamental rights which you must restore immediately. Same is evident through the case of State of M.P. V/s Kedia Leather and others, AIR 2003 SC 3236, 2003 CriLJ, JT 2003 (7), SC 370. Here also, the honourable Supreme court verdict that Right to live with human dignity become illusory in the absence of humane and healthy environment. Bhiwandi is definitely does not provide environment to live life with dignity.

4.      Even as per the Act Municipal Commissioner is responsible  for the maintenance of various infrastructure of the city like water supply, roads, storm water, drainage, and efficient delivery of various services to the citizen. I am sure you have been provided enough training at YASHADA before entering into state administrative services then how you missed in providing this services and doing your duty it is matter of concern and to think.


5.      We do not see any action against illegal slums, not constructed urinals and public toilets, no roads are widened and no development proposals from MMRDA have been implemented.
6.      Nothing has been spent on city’s development and where has the money gone, is matter of concern.

7.      It is reported on newspaper that you had nexus with politician and you allowed them to qualify the corporation election when you were supervisor for the election. Matter of surprise that how election commission and state government allowed you to become election officer for Bhiwandi and later to remain municipal commissioner of this corporation. For the same matter, Anti corruption bureau has registered a case against you but still you are holding municipal commissioner’s position- it is matter of concern.


8.      There is no official record with us (and even you have not provided your detailed bio data on corporation’s website) but it is believed that you are holding various positions in Bhiwandi for several years which seems impossible without a political nexus and a vested interest (if it is true).

9.      It is also reported that you pay a heavy sum of money to reporters (local as well as state dailies) for not reporting anything against you and your misconduct. It is equally surprising that the media which reports a theft, murder and political matters in newspaper do not report anything about all these serious issues.

Our demands
1.      All garbage should be disposed properly. To keep separate dust bin for dry and liquid waste to be made compulsory and penalize those who are not following it. Similar model of Mumbai to be implemented.

2.      The bigger and two separate garbage box should be kept in all area and it should be cleaned properly and multiple times in a day.


3.      You must disclose all funds received through state and union government on website and should be made it publicly available free of cost under Right to Information Act section 4 (b) (ii)  under voluntarily disclosure.
4.      All the roads and drainages must be repaired immediately and name of such construction contractor, date of award of contract, cost, money [paid, basis of selection of such contractor musty be disclosed on corporation’s website.

5.      Yours and officers of the concerned ward’s official mobile no should be made publicly available so people can directly complaint, also 24X7 functional, checked, operated and to be replied e-mail id to be publicly made available.


6.      The entire city municipal corporation road must be repaired and the road at Anjurphata the intersection of Kharbao-Bhiwandi-Thane and the Narpoli-Devji Nagar road immediately and please ensure not to use paver blocks. Preferably the concrete road with high quality materials. All the roads including internal city roads must be repaired and reconstructed (please no patch work) within a month’s period and please explain why it is not done.

7.      Enough urinals and public toilet must be constructed and people urinating in open should be penalized. (you cannot penalize people if you self have not made enough toilets and urinals). Marshals to be appointed to catch and penalize to ensure people do not spit and do not litter the city.

8.      Plastic should be completely banned and programme should be organized to encourage use of paper and cotton bags. License of the vendors supplying plastic bags to be cancelled.

9.      All the roads must be widened enough to pass at least two trucks at one time, there must be separate footpath for pedestrian’s walk. There must be no parking zone and clear sign of road and action against such vehicles to be taken like seizing vehicles, penalizing etc.

10.  Trees must be planted both side of the roads, watered, taken proper care and the city must be made green.

11.  Action against illegal construction must be taken immediately and criminal charges against such people involved in this to be filed. Bombay high court has such directive against various matter.


12.  You cannot give excuse about people of Bhiwandi being non cooperative and uncivilized. People do such act when they do not have fear of law. Fear of law vanishes when people see that law enforcing agencies are doing nothing and when they have nexus with the administration. Bihar has transformed from a lawless state to law abiding state. It happened due to proper and corrective administrative action. At least Bhiwandi is better than Bihar beyond any doubt.

13.  Immediate and strong action must be taken against all matters mentioned above so we do not need to take help of honourable high court for getting our rights.

14.  All garden, public recreation area must be taken care properly and must be developed. All the reserved area meant for playground, park to be vacated and developed, used. Legal action against people harming such places to be taken.

15.  All funds received under MMRDA, state, union government and through all other agency must be disclosed immediately and work done  also to be indicated with full details on website. The hard and soft copy of the same to be made available in every prabhag and HO.
P.S.: Please note that after filing this complaint, if any injury or harm happens to any of us our family and friends, all the people whom this communication address will be fully responsible. Considering the political set up of Bhiwandi, it is also expected that we get threatening from corporators and from the officials involved.

  1. i read the petition...i came to know that my father had booked two flats in ADESHWAR TOWER i.e. opp to devji nagar..as he had paid lacs of installments..as u mentioned it as a illegal construction now here i m wondering how 2 get back our money..also the builder not shown any kind of permission notice frm municipal corporation..here what remedy can be available 2 us..coz d builder can run away stage of time if order passed to stop the construction.

    I did not say that all the towers in Bhiwandi is illegal. Yes, most of are there.

    take survey no. hissa no and other details and then file an RTI application or else visit the municipal corporation and ask them to show you documents related to all construction approved in the city
